Having listened to the reports of the representatives of Ministries and other bodies of the executive power, the Council of the Ministers of the Autonomous Republic of the Crimea, Dnipropetrovsk, Donetsk, Zaporizhzhia and Kherson regional state administrations, and having scrutinized the informational-analytical materials received by the Committee, the participants of the hearings stressed that normative-legal base on the development of the integral system of dialogue between the parties of the social dialogue in the framework of bilateral and trilateral cooperation has been formed after the adoption of the Law "On Social Dialogue in Ukraine" on December 23, 2010.
The participants informed about formation of the inter-branch (inter-industry) council, specification and broadening of the authorities of the National trilateral social-economic council authorized to implement proposals and recommendations for the President of Ukraine, Verkhovna Rada of Ukraine and Cabinet of Ministers of Ukraine as to formation and implementation of the state economic and social policy, which shall be scrutinized by the state power bodies and local self-government agencies.
The speakers appreciated establishment of the National trilateral social-economic council as a standing body and standing trilateral advisory agencies under National Electricity Regulatory Commission of the Ministry on Infrastructure of Ukraine.
The participants of the hearings also briefed on collective negotiations concerning conclusion of the collective agreements and treaties as a practical realization of social dialogue.
Another form of social dialogue is the procedure of conciliation, which presupposes consideration of views of all parties, and development of coordinated decisions in the course of scrutinizing the drafts of normative-legal acts.
However, the speakers drew attention to the fact that central executive power often abuses the Law "On Social Dialogue in Ukraine" and provisions of the General Agreement. Thus, the authorities fail to direct the drafts of normative-legal acts to the social partners, etc.
